Terms of sale

These terms and conditions govern the purchase agreement between the buyer of the online store www.diviselavoro.it (hereinafter referred to as the "Buyer" for the sake of clarity) and Gapslab Sas & C Via Nuova Chiunzi, 91 - 84010 Maiori (SA ) (hereinafter referred to as the "Seller")

Content of the general conditions of sale

  1. The following general conditions of sale govern all sales contracts concluded between the Buyer and the Seller through the website www.diviselavoro.it. Each contract is subject to the general conditions of sale published on the site at the time the contract is concluded. Any modification proposed by the Buyer is not suitable for changing the general conditions of sale, unless expressly accepted in writing by the Seller.

Completion of the contract

  1. All product information on www.diviselavoro.it, such as technical specifications, images, dimensions or compatibility details are not binding and are subject to change at any time, unless they are expressly identified as binding.
    In the event that the Purchaser in the purchase is misled by the aforementioned indications, he may exercise the withdrawal referred to in point 9 Right of Return and Withdrawal  The offers on www.diviselavoro.it are not binding for the Seller and do not constitute public offer, but simple "invitatio ad offerendum".

    The Buyer's Purchase Order has the value of a binding contractual proposal. The Purchase Order is accepted by the Seller with an Order Receipt sent by e-mail, which contains an extract of the conditions of sale, the description of the characteristics of the product ordered, the essential elements of the contract (price, method of payment), the systems set up by the Seller for archiving the order and data custody, the procedures for correcting the message containing the order. The contract is finalized and comes into force when the Buyer receives the Order Receipt.

    The Order and the Order receipt are considered received when the parties to whom they are addressed have the possibility of accessing electronic messages. In the event that the Buyer does not receive the Receipt of the same from the Seller or other communication from the Seller within 24 hours of placing the Order, the Buyer is required to promptly contact the Seller via the address:  info @ diviselavoro. it

Purchase of products

  1. The Products displayed in the Catalog can be purchased by selecting them by the Buyer and then placing them in the appropriate cart. Once the selection of the Products has been completed and if you wish to proceed with the purchase of those included in the cart, the Buyer will be asked to release the requested data on the Site in order to allow the completion of the Contract. In particular, the Purchaser will be required to release his personal data, his e-mail address, his address as well as the address where to deliver the Products (if different from the first), and a number in a specific section of the Site. telephone where you can contact him in order to possibly inform him about the delivery date of the Products.

    If the customer requires a fiscal invoice, he must enter the relative data in the appropriate fields, otherwise the goods will be sent with a fiscal receipt without the possibility of subsequent invoicing.

Delivery of the goods

  1. Delivery times are approximately 7 days. working from the confirmation of receipt of payment and are not binding unless otherwise indicated in a separate agreement.

    However, the Seller does everything in its power to respect these times. The Seller procures directly from the warehouses of the producers who generally always have products ready, in case of shortages or delays, the Buyer will be informed and if he decides to cancel the order any payment already made by the Buyer will be refunded without further delays.

    Upon receipt of the goods, the Buyer must immediately check that the delivery is complete and correct and inform the Seller of any problem without delay by writing to the Customer Care e-mail address:  info@diviselavoro.it

Prices

  1. The price of the Products is that present on the site on the day the order is placed and before the Order is issued. The prices indicated relate to deliveries to addresses in Italy and include VAT

Customization of garments

  1. Embroidery directly on the garment on Max. 2 lines (only horizontal, no vertical, no oblique, no arched) for a maximum of 30 characters and in the maximum dimensions indicated at a cost of € 4.00 including VAT which will be automatically added to the price of the boss.

    It is possible to characterize the garments in a different way even with your personalized logo for a minimum of 12 pieces. In this case, we invite you to make a request by e-mail to the address:  info@diviselavoro.it  by sending more precise information and / or the logo file to be reproduced which will be followed by our detailed estimate.

    For customized items  there is no return or replacement  and payment can only be made in advance  (bank transfer - credit card - PayPal).

    1. Payments by bank transfer in advance (by paying by bank transfer the goods will be shipped only after verifying that they have been credited to our current account.)

      The reason to be reported on the bank transfer must indicate: the order number, the name and surname of the sender. In the current state of the banking system, the transferred amount is credited to the beneficiary's current account no earlier than 3/5 working days from the date of execution of the same. If we do not receive payment within 8/10 days of placing the order, the order will be canceled.

Payments by Credit Card - Paypal

    1. All payments are made through the Paypal platform, allowing us to guarantee full compliance with all current regulations in terms of security of economic transactions.        

Payments by credit card - GestPay Banca Sella

    1. Payments with major credit cards (Visa, MasterCard, etc.) at no additional cost. Online payment by credit card is guaranteed by a secure connection equipped with a very effective data encryption system. The credit card transaction takes place through the GestPay secure payment system provided by Banca Sella.

      All your credit card details are managed directly by Banca Sella, so no one will be able to view confidential information.                                                          

      The GestPAy system automatically encrypts all information regarding the payment transaction with a 128-bits SSL (Secure Sockets Layer protocol) (the highest level available for electronic commerce).                                                        

      Divise Lavoro never gets to know your credit card details. These data are sent (via a secure and protected connection) only to the bank that must provide the authorization: Divise Lavoro only receives the result of this authorization. Therefore, no data relating to your credit card will be transcribed on the documents relating to your order, nor will it be stored in our systems or those of the express courier. 

      Your personal data will be protected and used only when necessary: ​​to complete the purchase and issue an invoice for the sale, to facilitate your navigation on the site, to communicate the delivery address to the courier and (only in the case of payment by card credit card) to obtain debit authorization from Banca Sella. 

Warranty

  1. For products purchased by the Buyer, the rules on guarantees and assistance relating to the sale of consumer goods are applicable to the Seller.

Product liability

  1. The provisions of Directive 85/374 / EEC apply as regards damage caused by the product. The Seller, as distributor, is released from liability by indicating the name of the manufacturer.

Return and Withdrawal

  1. For any reason he is not satisfied with the purchase made, the Buyer will have the right to withdraw from the Contract, without any penalty and specifying the reasons by email, within 14 days from the date of delivery of the order. The Buyer may exercise the right of withdrawal, within the aforementioned terms, through the procedure specified below.

Conditions for exercising the right of withdrawal

  1. The right of withdrawal is exercised correctly if the following conditions are fully met:

    1. the products must not have been used, worn, washed or damaged, worked or customized;
    2. the products must be returned in their packaging with the original tag;
    3. returned products must be sent in a single shipment. Gapslab Sas & C, in fact, reserves the right not to accept items from the same order, returned and shipped at different times;
    4. returned products must be delivered to the courier within fourteen (14) days from the date they were received

    It is understood that the transport risks for the return of the Products will be fully borne by the Buyer.

Refund times and methods

  1. After the Seller has received the return and checked that all the requirements have been met, the Buyer will receive an e-mail confirming acceptance of the return. Whatever the payment method used, the refund is activated by Gapslab Sas & C in the shortest possible time, and in any case within thirty (30) days from the date on which it became aware of the exercise of the right of withdrawal, once it has been verified that the withdrawal took place in compliance with the above conditions.

Concluding provisions

If any of these general terms and conditions prove invalid or become invalid at a later date, this does not affect the validity of the rest of this contract. In this case, the invalid term is replaced with a term that represents its intent and economic purpose as closely as possible or with the appropriate legal provisions. The Seller reserves the right to amend these general terms and conditions at any time. The amended general terms and conditions are made accessible on the website www.diviselavoro.it.

Safety
